GDPR Terms & Conditions of FindRoom.ch

Effective Date: May 2025

Who We Are

Findroom.ch is a connecting platform only. These terms and conditions must be read and accepted by every user using www.findroom.ch.

Definitions

  • “User” refers to any person using the platform, including room owners and escorts.
  • “Advertisement” refers to any offer published by a user on the platform.

Purpose of the Platform

Findroom.ch is a connecting platform. We allow owners to publish their rooms and connect directly with escorts, without intermediaries, to arrange room bookings.

Please note that our site does not handle bookings directly. While adults can submit a booking request, only the property owner has the authority to confirm or deny the booking. After confirmation, the owner will provide the trip details, which serve as information only and are not official documents.

All aspects of booking, including communication, confirmation, management, and payment, are solely the responsibility of the property owner. We disclaim any responsibility for any interactions or transactions you may have with any owner on this site.

Owners can only pay for a membership. Escorts must speak and make the booking with the owner directly.

Only owners with legal establishments in Switzerland are allowed on Findroom.ch.

Findroom.ch is only destined to adults over 18 years of age. Only pictures of rooms are allowed; it is forbidden to upload any picture of a person, including yourself.

User Responsibilities

  • Users are responsible for the truthfulness and legality of the information they publish in their advertisements.
  • Users agree to comply with all applicable laws and regulations in their jurisdiction.
  • The platform cannot be held responsible for interactions between users or the consequences arising from them.

Advertisement Moderation

  • We reserve the right to moderate advertisements published on our platform.
  • We may delete or deactivate any advertisement that, in our sole discretion, violates our policies or applicable laws.
  • Owners of adult establishments are required to create and pay for a separate subscription for each of their locations. For example, if you own two salons, you must purchase two separate subscriptions to list each location individually. Failure to comply with this rule may result in the removal of your profile or advertisement without compensation, as it will be considered a violation of our policies.
  • We only grant “verified” status to establishments in Switzerland that have provided their operating authorizations to one of our agents. However, we do not guarantee the legality of the establishment, as we cannot verify the authenticity or validity of the documents submitted, nor can we confirm whether they may have expired. It is solely your responsibility to ensure the legality of the establishment you are visiting or operating.

Findroom.ch is only a connecting site. We have absolutely no connection and/or affiliation with the people mentioned here or with any websites. We are only an advertising space, we are not an erotic establishment nor a prostitution company, but only an advertising space. All information and media uploaded by users belongs to the user, and they assume full responsibility for the content they publish. We are not responsible for the content or conduct of any third parties or any person on Findroom.ch, with whom you may come into contact or about whom you have electronic or telephone contact information.

Media

If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.

Media uploaded on Findroom.ch belongs entirely to the uploader, and you must ensure that you own the rights.

Embedded Content from Other Websites

Articles on this site may include embedded content (e.g., videos, images, articles, etc.). Embedded content from other websites behaves in the exact same way as if the visitor has visited the other website.

These websites may collect data about you, use cookies, embed additional third-party tracking, and monitor your interaction with that embedded content, including tracing your interaction with the embedded content if you have an account and are logged in to that website.

Payment Processing & Legal Clarification

  1. Payment Processing:

    • All payments made on Findroom.ch for promotional services are processed through Rencla WebTech Sàrl (https://rencla-webtech.ch), a separate legal entity that handles all payment transactions for this website.
    • By proceeding with payment, you acknowledge and agree to the following:
      • The payment will be processed via Rencla WebTech Sàrl, and the charge will appear on your credit card statement as being from Rencla WebTech Sàrl.
      • The services purchased, such as promoting listings or rooms, are directly related to Findroom.ch. However, the payment and financial transaction itself are handled by Rencla WebTech Sàrl, which operates as an IT services company.
      • Findroom.ch provides the promotional service, but Rencla WebTech Sàrl is responsible for processing all payments.
  2. Payment Purpose:

    • The payment processed by Rencla WebTech Sàrl is for services related to Findroom.ch, but the financial transaction falls under the IT services category of Rencla WebTech Sàrl and is legally considered a transaction with that company, not with Findroom.ch website itself.

By using our services, you agree that the financial transaction is processed by Rencla WebTech Sàrl for promotional services on Findroom.ch, and Rencla WebTech Sàrl is solely responsible for handling the payment.

Website Operator

Every matter related to Findroom.ch is managed by the company operating this website:

Rencla WebTech Sàrl

How Long We Retain Your Data

If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue.

For users that register on our website (if any), we also store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.

What Rights You Have Over Your Data

If you have an account on this site, you can request that we erase any personal data we hold about you. This does not include any data we are obliged to keep for administrative, legal, or security purposes.

We may update our terms and conditions periodically. All changes will be posted on this page. It is your responsibility to review the terms and conditions regularly. By using the site, you acknowledge and accept the most current version of these terms and conditions.

Currency Display and Applicable Rates

Findroom.ch may display prices in various currencies for your convenience. These currency conversions are provided using regularly updated exchange rates and may vary from day to day. The displayed base currency may also change on certain days, depending on location, user settings, or internal platform updates.

However, users acknowledge and accept that all bookings, payments, and pricing obligations are ultimately governed by the amount stated in Swiss Francs (CHF). This CHF price is the only amount applicable and enforceable by the accommodation providers (establishment owners), regardless of which currency was displayed during browsing or booking.

By using Findroom.ch, you agree that the CHF price is binding and that any foreign currency amounts shown are approximate and non-binding representations.

FindRoom Pass — Partner Terms & Conditions (Owners)

These Terms & Conditions (“Terms”) govern your participation as a FindRoom Pass Partner (“Partner,” “Owner,” “you”) on the FindRoom platform operated by [Rencla WebTech Sàrl] (“FindRoom,” “we,” “us”). By enrolling your property or using any FindRoom Pass tools, you agree to these Terms.

1) Definitions

  • FindRoom Pass / Pass: A membership giving eligible travelers a discounted nightly rate or othey types of discounts at participating properties.

  • Property: Any accommodation you list (e.g., room, apartment, Erotic club, erotic salon, brothels).

  • Listing: The online presentation of your property on FindRoom, including rates, photos, policies, and rules.

  • Pass Holder: An individual meeting the Pass eligibility criteria and presenting a valid, verifiable Pass at check-in.

2) Program Enrollment & Listing Limits

  • Enrollment as a FindRoom Pass Partner allows you to list up to 15 rooms at no listing fee.

  • You may rotate which rooms are designated as Pass-eligible, but at any time no more than 15 rooms may be listed under the Pass without written approval from FindRoom.

  • You remain solely responsible for the accuracy and legality of your Listings (availability, rates, taxes, fees, house rules).

3) Required Discount & Price Presentation

  • You agree to offer Pass Holders at least 5% off the nightly room rate per room (the “Minimum Discount”).

  • If you prefer a different discount, tell us in writing (email or dashboard setting, if available) and we will update your Listing. Until updated, the Minimum Discount applies by default.

  • The minimum discount applies to the base nightly room rate only (exclusive of taxes, regulatory fees, salon fees, cleaning fees, and optional add-ons).

  • You may not surcharge Pass Holders or inflate base rates to negate the discount. Promotional parity is required: advertised Pass discounts must reflect a genuine reduction versus the same room, same dates, same cancellation terms offered to the general public on your direct channels.

4) Eligibility & Verification at Check-in

  • Pass Holders must be 18+ and European (resident of a European country, including EEA/CH/UK as applicable).

  • At check-in you must verify the Pass Holder’s eligibility by:

    1. Checking a valid government ID for name and date of birth (18+), and

    2. Scanning or recording the Pass details (e.g., name, Pass number/QR, and validity) in accordance with FindRoom’s verification instructions.

  • Only collect data necessary to verify eligibility and comply with local law. Do not retain copies of IDs unless required by law. Handle all personal data per Section 12 (Privacy).

5) Advance Notice Requirement by Pass Holders

  • Pass Holders must inform you before booking that they are using the FindRoom Pass so the discount can be applied at the time of booking/confirmation.

  • If a Pass Holder fails to provide advance notice, you are not obligated to retroactively apply the discount, though you should act reasonably where feasible.

6) Owner’s Right to Accept or Deny

  • You retain full discretion—consistent with applicable law and non-discrimination rules—to accept, confirm, or deny a booking request, or to deny entry (e.g., safety concerns, overbooking, house-rule violations).

  • You may not deny solely to avoid granting the Pass discount once a valid Pass booking has been accepted.

  • If you set blackout dates or room-type restrictions for Pass rates, you must clearly disclose these on your Listing in advance.

7) Failure to Honor the Discount

  • If a Pass Holder books your Property in accordance with these Terms and does not receive the agreed discount, FindRoom may, at its discretion, require you to refund the difference, credit the guest, and/or remove or suspend your Listing(s) from the platform. Repeated or material failures may result in termination under Section 16.

8) Rates, Taxes, Fees, and Payment

  • You are the merchant of record for charges to the guest unless otherwise expressly stated in writing.

  • You are solely responsible for all taxes, tourist levies, VAT, and required receipts/invoices.

  • Any additional fees (salon, cleaning, pet, local taxes) must be clearly disclosed prior to booking.

9) Cancellations, No-Shows & Overbooking

  • Your cancellation, change, and no-show policies apply if clearly disclosed on your Listing at the time of booking.

  • In case of overbooking or denial of entry after a confirmed booking, you must promptly refund any amounts you charged and follow your publicly stated relocation/refund policy, if any.

10) Content, Branding & Reviews

  • You grant FindRoom a non-exclusive, worldwide, royalty-free license to use, reproduce, adapt, and display your Listing content (text, images, logos) for marketing and platform purposes. You warrant you own or have rights to that content.

  • FindRoom may host, surface, rank, and moderate ratings/reviews at its discretion. You may not manipulate reviews or incentivize only positive feedback.

11) Compliance & House Rules

  • You must comply with all laws and regulations (licensing, safety, accessibility, fire codes, short-stay rules, data protection, anti-money-laundering, sanctions).

  • Maintain appropriate insurance (e.g., public liability/host liability) commensurate with your Property and local law.

  • House Rules must be lawful, conspicuous, and consistently enforced.

12) Data Protection & Privacy

  • Each party acts as an independent data controller for personal data it processes under these Terms, unless a separate written agreement says otherwise.

  • You must implement appropriate technical and organizational measures to secure guest and Pass data, limit use to verification/booking purposes, and observe data-minimization and retention limits required by law (e.g., GDPR).

  • You will promptly notify FindRoom of any data incident affecting Pass Holder data obtained via the Program where legally required.

13) Anti-Discrimination & Guest Safety

  • You must not discriminate against Pass Holders based on protected characteristics (e.g., race, religion, nationality, disability, gender, sexual orientation, age beyond the 18+ requirement) or Pass status.

  • You may refuse or terminate a stay when warranted by reasonable safety or legal concerns, provided actions are non-discriminatory and consistent with your posted policies.

14) Platform Functionality & Availability

  • FindRoom provides a marketplace and promotional tools “as is” and does not guarantee bookings, page rankings, revenue, or uptime.

  • We may modify features, update verification workflows, or run quality checks from time to time.

15) Fees & Changes

  • Current participation for up to 15 rooms is fee-free for listing. FindRoom may introduce or modify fees with reasonable prior notice. If you do not agree, you may terminate per Section 16.

16) Suspension & Termination

  • Either party may terminate participation for convenience with 30 days’ written notice.

  • FindRoom may suspend or terminate immediately for: (a) failure to honor discounts; (b) fraud or misrepresentation; (c) legal non-compliance; (d) material breach; (e) actions that harm guests or the platform.

17) Indemnity

  • You agree to indemnify and hold harmless FindRoom and its officers, directors, and employees from claims, damages, fines, costs, and expenses arising from: (i) your Property (conditions, safety, services), (ii) your Listings, pricing, taxes, and fees, (iii) your breach of these Terms or law, or (iv) your misuse of personal data.

18) Limitation of Liability

  • To the maximum extent permitted by law, FindRoom’s aggregate liability arising out of or related to these Terms shall not exceed the greater of CHF 100 or the total fees (if any) paid by you to FindRoom in the 12 months preceding the event giving rise to liability.

  • Neither party is liable for indirect, incidental, special, punitive, or consequential damages (including lost profits or goodwill).

19) Force Majeure

  • Neither party is responsible for delays or failures caused by events beyond reasonable control (e.g., natural disasters, strikes, power/network outages, government actions, war, epidemics), provided the affected party uses reasonable efforts to mitigate.

20) Audit & Quality

  • FindRoom may conduct spot checks (e.g., mystery bookings, rate/discount validation) to ensure compliance. Reasonable cooperation is expected. Repeated non-compliance may result in suspension or termination.

21) Communications & Notices

  • Official notices may be sent to the email or admin address associated with your Partner account or via dashboard notifications. Notices are deemed received when sent.

22) Changes to the Terms

  • We may update these Terms from time to time. Material changes will be notified with reasonable advance notice. Continued participation after the effective date constitutes acceptance.

23) Governing Law & Dispute Resolution

  • These Terms are governed by the laws of Switzerland, without regard to conflict-of-laws rules.

  • The exclusive venue for disputes is the courts of Vaud, Switzerland.

  • Before filing, the parties will attempt good-faith negotiation for at least 30 days.

24) Miscellaneous

  • Entire Agreement: These Terms (and any incorporated policies) are the entire agreement regarding the Program, superseding prior discussions.

  • No Agency: You and FindRoom are independent contractors; no partnership, joint venture, or employment is created.

  • Assignment: You may not assign these Terms without our written consent. We may assign to an affiliate or successor.

  • Severability: If any provision is unenforceable, the remainder remains in effect.

  • No Waiver: A failure to enforce any provision is not a waiver of that provision.

Operational Addendum (Owner Checklist)

  • Display Pass rate logic and any blackout dates clearly on your Listing.

  • Train front desk or your staff to verify Pass and apply the correct discount at booking or check-in.

  • Keep transparent base rates; don’t offset the discount with hidden charges.

  • Maintain records of Pass verifications (date, Pass ID, discount applied) in a privacy-compliant manner.

  • Have a clear overbooking and cancellation policy visible on your Listing.

  • Ensure insurance and safety compliance are up to date.

FindRoom Pass — Holder Terms & Conditions

Effective date: [insert date]
Last updated: [insert date]

These Terms & Conditions (“Terms”) govern your use of the FindRoom Pass (“Pass”) provided by [FindRoom entity name] (“FindRoom,” “we,” “us”). By purchasing, activating, or using a Pass, you agree to these Terms.

1) What the FindRoom Pass Is

  • The Pass is a membership benefit that gives eligible travelers a discounted nightly rate at participating FindRoom Pass Partners (“Partners,” “Owners”).

  • Partners list up to 15 rooms on FindRoom with a Pass discount. The minimum discount is 5% off the base nightly room rate unless the Partner has told us a different Pass discount for their listing.

2) Eligibility

  • You must be 18+ and a European resident (EEA/Switzerland/UK, as applicable) to hold and use a Pass.

  • You must be able to present a valid government ID at check-in showing your name and date of birth that matches your Pass profile.

3) Non-Transferability & Proper Use

  • The Pass is personal and non-transferable. Only the named holder may use it.

  • Resale, lending, or sharing of Pass credentials is prohibited.

  • The Pass is for personal travel only (not for acting as an agent, reselling inventory, or group bookings unless a Partner explicitly agrees in writing).

4) How Discounts Work

  • Unless otherwise stated on the listing, the Pass discount is at least 5% off the base nightly room rate for Pass-eligible rooms.

  • The discount does not automatically apply to taxes, regulatory fees, resort/cleaning fees, or optional add-ons unless indicated by the Partner.

  • Partners may set blackout dates, room-type exclusions, minimum-stay requirements, or different Pass discounts; these should be disclosed on their listing.

5) Your Responsibilities Before Booking

  • You must inform the Partner before booking that you are a Pass holder so the discount can be applied at time of booking/confirmation.

  • Book only the rooms/dates shown as available by the Partner. If unsure whether a Pass rate applies, contact the Partner before you book.

6) Check-in Verification

  • At check-in, the Partner must verify your eligibility by scanning your Pass (e.g., QR/number) and matching it to your valid ID.

  • If the Pass is invalid/expired, does not match your ID, or eligibility cannot be verified, the Partner may charge the standard rate or deny entry consistent with their policies and applicable law.

7) Partner’s Right to Accept or Deny

  • Partners retain discretion—consistent with law and non-discrimination rules—to accept, confirm, or deny booking requests or entry (e.g., safety, overbooking, house-rule concerns).

  • A Partner may not deny solely to avoid applying a valid Pass discount after a booking is accepted.

8) If You Didn’t Receive the Discount

  • If you booked in line with these Terms and the Partner’s listing but didn’t receive the agreed discount, contact the Partner first to resolve it.

  • If unresolved, contact FindRoom Support with your booking details and proof. FindRoom may ask the Partner to refund the difference, credit you, and/or may remove/suspend the Partner’s listing for repeated failures. FindRoom is a marketplace and does not guarantee reimbursement but will take appropriate platform actions.

9) Cancellations, No-Shows & Changes

  • Each Partner’s cancellation/change/no-show policy applies if disclosed at booking.

  • You are responsible for understanding these terms prior to confirming a reservation. Fees for late cancellation or no-show may apply per the Partner’s policy.

10) Fees, Taxes, and Payments

  • Unless otherwise stated, you pay the Partner directly as merchant of record.

  • You are responsible for all taxes, fees, and mandatory charges disclosed by the Partner (tourist taxes, resort/cleaning fees, etc.).

  • Obtain receipts or invoices directly from the Partner.

11) House Rules & Conduct

  • You must comply with each Partner’s house rules, check-in/check-out times, occupancy limits, and safety requirements.

  • Disruptive, illegal, or unsafe behavior may lead to denied entry, eviction, and/or charges under the Partner’s policies.

12) Data Protection & Privacy

  • At booking and check-in, Partners may collect limited data required to verify Pass status and comply with local law (e.g., name, Pass ID/QR, validity, and where required, ID details).

  • FindRoom and Partners are generally independent data controllers. Your data is processed to deliver the Pass benefit, prevent fraud, and meet legal obligations (e.g., guest registries).

  • Exercise your privacy rights (access, deletion, etc.) with the relevant controller (FindRoom for Pass account data; the Partner for property-level guest data).

13) Fraud, Misuse & Suspension

  • FindRoom may suspend or terminate your Pass without refund for:

    • Misuse (sharing, falsifying eligibility, impersonation),

    • Abusive behavior toward Partners or staff,

    • Repeated chargebacks or suspected fraud, or

    • Breaches of these Terms or applicable law.

14) Availability & Platform Changes

  • FindRoom lists Partners and Pass offers on an “as is” basis and does not guarantee availability, specific discounts, number of listings, or uptime.

  • We may update features, verification steps, and Pass benefits periodically.

15) Membership Term, Renewal & Refunds (If Applicable)

  • Your Pass is valid for the period shown in your account or purchase confirmation.

  • Fees (if any) and renewal terms are as stated at purchase. Except where required by law, Pass fees are non-refundable once the Pass is activated or used.

  • You are responsible for canceling any auto-renewal per the instructions provided at purchase (if auto-renewal applies).

16) Accessibility & Non-Discrimination

  • Partners must comply with applicable non-discrimination laws. If you believe you were discriminated against, report it to FindRoom and, where appropriate, to relevant authorities.

  • For accessibility needs, contact the Partner prior to booking to confirm suitability of the room and facilities.

17) Travel Risks & Third-Party Services

  • Stays are provided by independent Partners. FindRoom is not the operator of the property and is not responsible for property conditions, services, or acts/omissions of Partners or guests.

18) Limitation of Liability

  • To the maximum extent permitted by law, FindRoom’s aggregate liability related to the Pass shall not exceed the greater of CHF 100 or the amount you paid to FindRoom for the Pass in the 12 months preceding the claim.

  • Neither FindRoom nor you are liable for indirect, incidental, special, punitive, or consequential damages (e.g., lost savings, lost time).

19) Indemnity

  • You agree to indemnify and hold harmless FindRoom for claims and losses arising from your misuse of the Pass, breach of these Terms, or violation of law.

20) Force Majeure

  • Neither party is liable for failures caused by events beyond reasonable control (e.g., natural disasters, strikes, outages, war, public health emergencies).

21) Reporting Issues & Support

  • Report discount issues, suspected fraud, or Partner policy violations to FindRoom Support promptly and provide documentation (booking confirmation, receipts, screenshots). Timely reporting helps us act.

22) Changes to These Terms

  • We may update these Terms from time to time. Material changes will be notified with reasonable advance notice. Continued use of the Pass after the effective date constitutes acceptance.

23) Governing Law & Dispute Resolution

  • These Terms are governed by the laws of Switzerland, without regard to conflict-of-laws rules.

  • The exclusive venue for disputes is the courts of Vaud, Switzerland.

  • Before filing, both parties will attempt good-faith resolution for at least 30 days after written notice.

24) Miscellaneous

  • Entire Agreement: These Terms and any referenced policies are the entire agreement regarding the Pass.

  • Severability: If any provision is unenforceable, the remainder remains in effect.

  • No Waiver: A failure to enforce any provision is not a waiver.

  • Assignment: You may not assign your Pass or these Terms. FindRoom may assign to an affiliate or successor.
